Nothing To Do With Us - avoiding libel prosecution

by Garfield Lucas

In a flurry of activity prior to the reform of British libel laws, Internet service providers Microsoft, Europe Online and CompuServe are urging the UK Lord Chancellor to clarify the law concerning libel on the net.

In a recent submission to the Lord Chancellor's Office, the three firms explained that service providers cannot control the messages that their users post. They are hoping to persuade the Chancellor that unless the service providers have reasonable time to remove the offending message, and has the authority to do so, they should not be held responsible for any libellous statements posted.

Of course, this begs the question, who will be liable?
